1. Acceptance of Agreement

By accessing, browsing, or using the software services, AI-driven automation systems, and marketing solutions provided by SmallBizOnAI.com (“Company,” “we,” “us,” or “our”), you (“Client,” “User,” or “you”) acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you are prohibited from using our services.

2. Service Description and Third-Party Infrastructure

SmallBizOnAI.com provides specialized automation and CRM solutions for service-based businesses (e.g., landscaping, HVAC) using the HighLevel, Inc. software infrastructure. You acknowledge and agree that:

• SmallBizOnAI.com is an independent entity and is not owned, operated, or endorsed by HighLevel, Inc.

• Your use of the platform is subject to both these Terms and the GoHighLevel Acceptable Use Policy.

• The functionality of your sub-account relies on third-party integrations (e.g., Twilio, Google, Meta).

3. Communication and Compliance Obligations

As a user of AI-driven messaging and calling tools, you hold sole responsibility for compliance with all federal and local regulations, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and A2P 10DLC registration requirements.

• You must maintain documented proof of "Opt-In" consent for every lead/contact you communicate with via SMS or email.

• You must include clear, functioning "STOP" or "Unsubscribe" mechanisms in all outgoing communications.

• SmallBizOnAI.com reserves the right to terminate your account immediately, without refund, if your account is flagged for spam or if your communication practices violate telecom carrier policies.

4. Account Security and Business Information

You are solely responsible for the security of your sub-account access credentials. You agree to provide accurate, current, and complete business information during the onboarding process. Any failure to provide accurate business details (such as correct address for Google Business Profile sync) may lead to service disruption, for which SmallBizOnAI.com is not liable.

5. Billing and Subscription

• Recurring Fees: Subscription fees are billed automatically on a recurring basis as agreed upon at sign-up.

• Authorization: By providing payment details, you authorize SmallBizOnAI.com to charge the provided payment method for all subscription fees and applicable taxes.

• Refunds: Unless otherwise specified in writing, all fees are non-refundable.

6. Limitation of Liability

To the maximum extent permitted by applicable law, SmallBizOnAI.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the platform or the failure of any automated systems.
